Senate approves law
for recognition, protection
paths and educational diagnostic
After a long legislative process was approved Today (Wednesday, September 29, 2010) by the Senate that the law recognizes and defines some specific learning disorders (ASD) in school such as dyslexia, dysgraphia, dyscalculia and dysorthography. A rule adopted today that during the deliberation by the 7 th Standing Committee (Public education, cultural heritage, scientific research, entertainment and sport) that recognizes the existence of these disorders by stimulating the school in early detection and defining the locations of the diagnostic. "There is satisfaction that today's approval comes after a long rulemaking process that attests to the existence and extending legal protection to about 350,000 students, representing 5% of the population of school age who are suffering from these disorders" , said President of AID (Association of Italian dyslexia), Rosabianca Leo. The law, which will be a budget of 2 million euro in total for the years 2010-2011, provides for the right to use the compensation measures and dispensers throughout the school curriculum including University and ensure the preparation of teachers and school leaders. For the families will also be given the opportunity to take advantage of flexible working hours. Moreover, if the diagnosis is not available at the facilities of the NHS, the law gives the possibility of at accredited facilities.

"I am satisfied, even as a parent, because this law recognizes finally after many battles the existence of dyslexia and other specific learning disorders by stimulating the school to early detection and defining the places of the diagnostic and teaching. We are already working with the Ministry of Education, which we have appreciated the willingness to address this issue, relating to guidelines on the law. What is certain is that we are only at the beginning of a journey that must be undertaken with schools, especially on the issue of training in the management and structures of the NHS. The text is certainly a leap in quality compared to the past but should be improved both in terms of the assessment on its actual application is for example the inclusion of penalties for those who do not meet the legal requirements. We recognize, as an association, that things do not change quickly but the approval of today gives us more strength to improve the text and to better protect the rights of people with disorders of dyslexia. The law in detail
After the definition of dyslexia, dysgraphia, dyscalculia and dysorthography highlighted in the first article of the Bill, in the second paragraph of text highlights the objectives for which it the standard including the promotion of academic achievement, including measures of educational support, ensuring appropriate training that promotes the development of potential through the preparation of teachers and raising awareness of parents towards issues related to the DSA. During the training process (Article 4) Teachers should also have adequate educational preparation, methodology and evaluation on issues relating to the DSA. Another aspect is that concerning the diagnosis (Art. 3) to be made within the scope of specialist treatments already provided by the NHS to existing legislation and will be communicated from the family to home school student. The regions in the territory of which can not be made in the diagnosis of specialized treatment provided by the NHS may, within the limits of resources, the same diagnosis is made by specialists or accredited facilities. Remarkable, then, Article 5, which puts on paper the measures of education and instructional support such as the use of an individualized and personalized education or the introduction of compensatory measures, including means of alternative learning and information technologies, and measures dispensatory some services are not essential to the quality of the concepts to learn. It is also planned for the teaching of foreign languages, the use of compensatory measures that encourage verbal communication. Students with ASD are also guaranteed, along the way education and training in schools and universities, appropriate forms of monitoring and evaluation, including on the state exams and college entrance exams and the university. Article 7, however, is listed as four months after entry into force of the law, through a decree of the Minister of Education, University and research, in consultation with the Minister of Health, after reaching agreement in the Permanent Conference for Relations between State, Regions and Autonomous Provinces of Trento and Bolzano, a decision to issue guidelines for the preparation of regional protocols to be concluded within the next six months. Article 8 will be highlighted as they are subject to the powers of the special statute regions and autonomous provinces, which will have within three months from the date of entry into force of this Act to provide for implementing the provisions of the law.
